LEAVE AND LICENSE AGREEMENT IN MAHARASHTRA

Residential or commercial real estate rentals in Maharashtra are commonly executed under Leave and License. Registration of Leave and License document proves the validity and enforceability of the document. To prove any dispute between the parties, the agreement will have to be produced before the Court. However, if such agreement is not registered then such agreement will not be enforceable and not admitted by the Court.

In state of Maharashtra, leave and license agreement for any period, even less than a year, is required to be mandatorily registered. More details in the blog .. The provisions of Leave and License are incorporated in the INDIAN EASEMENT ACT, 1882 in SS. 52 TO 64. The implementations of these provisions is governed by the THE MAHARASHTRA RENT CONTROL ACT, 1999.

Benefit to Owners: High value property is safe and secure through a Leave and License Agreement. Dispute can be settled in court only if agreement is registered.

Benefit to Tenants: Tenant has paid a refundable deposit to the owner which is documented in the leave and License Agreement. Tenants deposit is secure through this agreement and owner is liable according to law to return the deposit on end of term of the agreement. Dispute can be settled in court only if agreement is registered

    The owner or Tenant need not come to your location for Biometric verification rather we would arrange his Biometrics at his/her place. This service costs extra amount which will be intimated to you separately.

    Yes. You can register any type of property with us provided it should be a legal entity.

    Multiple owners/Tenants can be added provided they have Aadhaar and PAN number

    No, it’s not possible to customise the agreement as per needs. Its a Government recognised format, that covers most of the Tenancy clauses. There is a Miscellaneous Section is available to where additional conditions up to 1000 characters can be added.

    After submission it will take maximum 4-5 working days to get the Rent Agreement registered. We keep our clients updated on the status; in case of any delay due to technical or any server issues, from the Government.

    If you don’t have Aadhaar card, you will have to go for offline registration.

    For Police verification, you just need to fill up a form and submit to the nearest Police Station. We provide you all information and guidance required to complete this process Free of Cost. We do not personally assist you with it.
